Odebrecht | George cheap | Lava Jato | Canceling company tests in Brazil will not affect cases in Peru | principle

case Otbrecht One of the politicians involved has been disarming Brazil since Luiz Inacio Lula da Silva returned to the presidency in January of this year. However, this situation does not affect Peru, which administers its own judicial mechanisms.

For example, the country’s Federal Supreme Court (STF) yesterday quashed all evidence obtained through a cooperation agreement with the company that could help prosecute bribed politicians. Practically, it buried the Lava Jato case in Brazil.

The decision follows an earlier ruling barring the STF from using evidence obtained through MyWebDay and Drousys, the computer systems where the company recorded bribery.

The Brazilian justice system concluded that there was no legal custody of the documents from both sites and that there was an informal administration that did not guarantee the quality of the information.

Even Brazilian judge José Antonio Diaz Toffoli described the sentence against Lula da Silva, who served 580 days in prison, as “one of the country’s greatest miscarriages of justice.”

It is noteworthy that Diaz Toffoli was the president’s lawyer between 2002 and 2006 and the leader of the Labor Party.

Peru is a separate story

According to criminal lawyer Fernando Silva, recent judicial decisions adopted in Brazil do not affect criminal proceedings in Peru, as they are different systems.

In conversation with Perú21TVHe said the ruling was “not formally communicated to the Peruvian state”.

He also clarified that the attorney’s office has verified every statement of the former directors with evidence. That is, elements other than those prohibited by Brazil are dealt with.

“There was a confirmation stage in the effective cooperation process in Peru, where all the elements were provided to confirm what the administrators announced,” Silva explained.

For his part, former President Ollanta Humala’s lawyer Wilfredo Pedraza told this newspaper that the resolution only has consequences on Brazilian territory.

He pointed out that it would be futile to invoke it in the investigation of his sponsor, who is accused of receiving money from Odebrecht to finance his 2011 campaign, because it did not implicate him directly.

Pedraza said that what should be followed is that MyWebDay and Drousys’ information should not be used.

Judge Nyko Coronado made it clear at Humala’s hearing this week that he will exercise internal jurisdiction until the process is complete.
