Article 1. Meaning of law
The objective of this Act is to gradually implement the technological restructuring of new generation networks in public fixed and mobile broadband internet service facilitating better connectivity in rural areas and priority areas of social interest.
Article 2. Purpose of Act
The purpose of this Act is to bridge the digital divide in public telecommunication services, ensure guaranteed minimum speed of fixed and mobile broadband internet without affecting service coverage allowing better economic, productive and social conditions and priority social benefits in rural areas.
Article 3. Measures to promote the implementation of new generation networks in fixed and mobile broadband Internet
Measures to promote the implementation of next generation broadband networks considering the use of available telecommunication infrastructure include:
a) Since the enactment of this Act, regulations governing the regulation of telecommunications infrastructure for broadband connectivity shall require an Ex-Regulatory Impact Analysis (AIR) as provided in Legislative Decree 1310, Act. Decree authorizing additional measures of administrative simplification.
b) Within a period of six months from the entry into force of this Act, the Supervisory Agency for Private Investment in Telecommunications (Osiptel) shall carry out a comprehensive review of the current regulatory framework with a view to simplifying it. Removal of regulations or obligations that do not comply with the principles of effectiveness, efficiency, necessity and proportionality.
c) The Ministry of Transport and Communications shall identify beneficiary rural areas and areas of priority social interest to facilitate progressive implementation of better telecommunication services. To do this, it comprehensively evaluates the technical and economic conditions of the areas in question, taking into account their geographical characteristics and the deployment of infrastructure, as well as the deployment of transport and access networks that facilitate the operation of broadband Internet. d) The Ministry of Transport and Communications evaluates the technical, economic and contractual conditions that allow for the transfer of the obligations obtained by providing public telephone services through mobile, for access to better telecommunication services in rural areas and prioritizing social welfare. or fixed broadband services.
e) Obligations of minimum guaranteed speed of 70%, as well as maximum asymmetry and asymmetry between the upload and download rate provided for in Law 31207, law guaranteeing minimum speed of Internet connection and monitoring of Internet service. In favor of users, the contract of broadband internet services that support access networks for new generation technology applies. If the installed technical infrastructures are the same, the supervision of the Internet speed obligations is carried out based on the comparison of the average instantaneous speeds of the region.
Article 4. Creation of digital single window to expedite deployment of telecom infrastructure at national level
The Ministry of Transport and Communications is creating a digital single window for the use of telecommunication infrastructure as a single channel for processing its permits. To do this, it coordinates with the Ministry of Culture and the Ministry of Environment to coordinate the requirements and conditions necessary to obtain authorizations allowing the use of telecommunications infrastructure.

The Executive Power, through the Ministry of Transport and Communications, regulates this law within sixty calendar days from the date of its publication in the official newspaper El Peruano. Likewise, a period of sixty calendar days has been established for the Supervisory Agency for Private Investment in Telecommunications (Osiptel) to implement its regulatory framework, including quality regulation of public telecommunications services, in accordance with the provisions of this Act.
