The lawyer began his presentation before Judge Raul Justiniano, who is in charge of evaluating the request with a review of the case. Thus, he explained that he was being investigated by Salatiel Marrufo, a former adviser who allegedly paid Sada Goray to the government officials of Pedro Castillo for S/ 5.4 million. This was in exchange for favors for his business interests through appointments he recommended at FMV and other companies affiliated with Pedro Castillo’s government, such as SUNARB and SPN.

A counselor was contacted, a lawyer was hired, and the interrogators began to meet. In one of these meetings, on September 8, Sada Gore agreed to pay S/ 4 million to appoint directors to the Mivivienda Fund, which supports the interests of his business company Marga Group. Missed information, missed opportunity

Later, the lawyer stopped to describe the idea of ​​a “victory bonus” allegedly given to Mauricio Fernandini and Pilar Dijero by Sada Gore. According to the prosecutor’s thesis, the journalist participated in the first five deliveries to Salatiel Marroufo between September and December 2021 for a total of S/ 3 million.

The lawyer stressed that this interaction with the investigating officers was not limited to participating in meetings and distribution of money. He also claimed to have “full knowledge” that the illegal agreement between those involved was aimed at “defrauding the state” as he knew how the FMV trusts worked to develop schemes promoted by Sada Korey.

Thus, Mauricio Fernandini is said to have received a total of “S/ 150 thousand and US$ 80 thousand” as a winning bonus for his “distribution” in favor of Sada Korey’s alleged network. Earlier, the person under investigation tried to give an honest confession, admitting that he only received S/ 60,000 for renting his apartment to hold Sada Gore meetings.

However, today this version is considered to have been distorted by the collected evidence and leans more towards the “victory bonus” line. For the Public Ministry, this is reinforced by the fact that the person under investigation failed to report facts such as the December 2021 WhatsApp conversation with Sada Korey.

“This person would have accepted an honest confession. However, from the development of his speech, he omitted relevant information, thus clarifying the truth […] During these days of preliminary detention, Mr. Fernandini did not correct the report, which he cautioned against releasing the data. Although he took advantage of this commutation, he remained silent”said the lawyer.

A representative of the Public Ministry also explained that he was charged with money laundering for allegedly introducing illegal money into the banking system as a result of these corrupt practices. Leaving the trial, Mauricio Fernandini’s lawyer criticized the prosecution for seeking his preliminary arrest despite his honest confession.

“He was stopped and arrested. What the lawyer says is: We have arrested him, asked him to testify again, he doesn’t want to testify. So, he misses out on honest confession because he doesn’t want to declare, but let’s get to the context, where is he? How are you?”Gino Dagnino said.

10 million by Sada Korey

As part of his presentation, in January 2022, Sada Korey also asserted that he “gave” 10 million soles to Salatiel Marrufo and Keyner Alvarado. The money will come from the sale of land in Beura for the National Training Service for the Construction Industry (Senseco).

The alleged plan was that of that sum, two million would go to Pedro Castillo to keep both in their positions. According to Salatiel Marrufo, Geiner Alvarado said in July of that year that he was going to give two million to the former president.

Although the alleged plan never materialized, the prosecution insists there was a “criminal contract” involved, which is reflected in the appointment of Gonzalo Arrieta, who is now under investigation, as Sensico’s executive chairman. Arrieta was already one of the named FMV directors under the influence of Sada Korey.

The person involved was the general manager of FMV until a few days ago

At another point during the hearing, the prosecutor warned that one of the people involved in the investigation had worked as FMV’s general manager until a few days ago, which “complicated” his investigation. The prosecution pointed out that in a meeting with FMV directors on September 30, Sada Gore showed a blackboard on which were written all the changes he wanted to make in the management of FMV. “Until today, Mr. Juan Carlos Toledo Baldión holds the position of General Manager of FMV. Also, apparently, the Public Ministry has some problems with the fluidity of information review. For this reason, the Ministry of Public Works and the Ministry of Housing, Construction and Health have this kind of hurdle,” the lawyer said.

From FMV, El Comercio noted that Toledo Baldión left general management by agreement of the board of directors and that “Mr. Carlos Falla Avellaneda is now in charge.” However, after he left that position, he returned to his position as operations manager.

After the prosecution presented the facts of the case in the five-hour hearing, the sitting of the judge adjourned till 10:00 am this Friday.
